QUOTE

Christopher Scott Corben showed a propensity to use "cunning and stealth" to satisfy his deviant sexual desires in alleged rape attacks in two Sydney nightclubs, a judge said.

The 30-year-old from the southern suburb of Lilli Pilli was on remand but has been permitted to return home to his parents under strict bail conditions - including "immediate psychiatric intervention".

"I am well satisfied that this applicant does in fact pose a considerable risk to the community - in particular young women," NSW Supreme Court Justice Elizabeth Fullerton said on Thursday during a bail application.

"That said, bail should only be refused when that risk cannot otherwise be (eliminated).

"There is every indication of the applicant suffering a subclinical psychiatric disorder."

Corben must agree to live with his parents, abide by a strict curfew, not drink any alcohol or visit any licensed premises, and he must arrange his first doctor's visit within 24 hours of being released from prison, the judge said.

The rest of the story does mention that he had been beaten up in jail and was put in protective custody, that if convicted of the rapes he would spend a lengthy time in jail, and that there is every indication of the applicant suffering a subclinical psychiatric disorder.......

....but COME ON!! Would the Judge have still made the same ruling and granted bail if it was someone she knew who had been raped and violated? groan.gif

And can his parents really keep that close of an eye on him? They have to sleep sometimes!

So - who's checking that he's doing all the right things? It's wrong to put that onto the parents - many parents wouldn't believe their son did those things, so wouldn't keep too close an eye on him. And even if they want to, how do they do that for every minute?

The judge acknowledges he's a danger and she's decided to let him out anyway, so she should be legally and financially liable for any crimes he commits while he's out.
